SOCIAL MEDIA PRIVACY POLICY
Who is responsible for processing your personal data?
BIEL GLASSES, S.L will be responsible for processing the personal data of individuals who have created a profile on any of its social media platforms. These data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of April 27 (GDPR), Organic Law 3/2018 of December 5 (LOPDGDD), and the Law on Information Society Services and Electronic Commerce (LSSI). We provide the following information about this processing:
Why do we process your personal data?
Purpose of processing: To maintain a relationship between the USER and BIEL GLASSES, S.L (hereinafter referred to as the CONTROLLER), which may include the following operations:
Handling requests and inquiries submitted to the controller.
Informing about activities and events organized by the controller. Providing information about products or services offered by the controller. Interacting through official profiles.
When the CONTROLLER collects and processes personal data via its social media platforms, USERS will be informed about the purpose of data collection and their rights regarding their personal data. Personal data will be used only for the specified purposes and will be securely maintained.
Legal Basis for Processing: Explicit consent granted by the USER for the processing of their personal data for one or more specific purposes (Article 6.1.a GDPR). Additionally, USERS can access the privacy policies of the respective social networks at any time and configure their profile to ensure privacy.
How long will we retain your personal data?
Data retention criteria: The data will be retained until the USER revokes the consent given, as indicated in this privacy policy.
Who do we share your personal data with?
Data disclosure: Information provided by the USER through the CONTROLLER’s social media, including their personal data, may be published, depending on the services the USER uses, and may thus become publicly available to other third-party users of the social media. From each social network profile, USERS can configure what information they want to make public in each case, view the permissions granted, delete them, or disable them, just like any third-party application they no longer wish to use. However, no personal data will be disclosed to third parties outside the social network unless it is essential for the development and execution of the processing purposes. In such cases, the CONTROLLER has signed confidentiality and data processing agreements with its communication service providers, as required by current privacy regulations.
What are your rights?
Rights of the USER: These rights can only be satisfied regarding information under the control of the CONTROLLER.
• Right to withdraw consent at any time.
• Right of access, rectification, data portability, or erasure of your data, and the right to restrict or object to its processing.
• Right to file a complaint with the supervisory authority (www.aepd.es) if you believe that the processing does not comply with current regulations. 2. USE OF THE PROFILE
The CONTROLLER will carry out the following actions:
• Access to public information on the profile.
• Posting on the USER’s profile of any information already published on the CONTROLLER’s social network. • Sending personal and individual messages through the social network’s channels.
• Updates on the page’s status that will be published on the USER’s profile.
The USER can always control their connections, delete content they are no longer interested in, and restrict who they share their connections with. To do so, they must access their settings, where they will find various configuration options related to the privacy of the user profile on the social network.
3. POSTS
The purpose of social networks is to provide visibility and dissemination of the activities carried out by the CONTROLLER. These tools store personal data on the servers of the respective services and are governed by their own privacy policies. Once a USER becomes a follower or joins the social network of the CONTROLLER, they can post comments, links, images, photographs, or any other type of multimedia content supported by the network. In all cases, the USER must be the owner of the published content, have copyright and intellectual property rights, or have the consent of the affected third parties. Expressly prohibited are any publications on the social network, including texts, graphics, photos, videos, etc., that infringe or may infringe on morality, ethics, good taste, or decorum, and/or violate or breach intellectual or industrial property rights, image rights, or the law. Offensive, defamatory, illegal, or inappropriate comments or content will not be tolerated on the company’s profiles. The Company reserves the right to delete such comments or content and to block the responsible users. In these cases, the CONTROLLER reserves the right to immediately remove the content, without prior notice, and may request the permanent blocking of the USER.
The CONTROLLER is not responsible for the content that USERS have freely published.
USERS should be aware that their posts will be visible to other users, making them primarily responsible for their own privacy. Images that may be published on the social network will not be stored in any file by the CONTROLLER but will remain on the social network.
4. DATA OF MINORS OR INDIVIDUALS WITH SPECIAL NEEDS
Reviewing and reading the terms of use and privacy policy of each social network at the time of registration is recommended, taking into account the different age requirements for registration. Furthermore, the CONTROLLER will be expressly exempt from any liability that may arise from the use of social networks by minors or individuals with special needs, whose access should be supervised and controlled by their legal representatives. The CONTROLLER reserves the right to modify this policy at any time. Changes will be communicated through our social media profiles and/or our website.
POLÍTICA DE PRIVACIDAD REDES SOCIALES
1. INFORMACIÓN A LA PERSONA USUARIA
¿Quién es el responsable del tratamiento de sus datos personales?
BIEL GLASSES, S.L será el responsable del tratamiento de los datos personales de aquellas PERSONAS que han procedido a crear un perfil en cualquiera de sus redes sociales, y los mismos serán tratados de conformidad con lo dispuesto en el Reglamento (UE) 2016/679, de 27 de abril (GDPR), la Ley Orgánica 3/2018, de 5 de diciembre (LOPDGDD), y la Ley de Servicios de la Sociedad de la Información y Comercio Electrónico (LSSI), facilitando la siguiente información del tratamiento:
¿Para qué tratamos sus datos personales?
Finalidad del tratamiento: para mantener una relación entre la PERSONA USUARIA yBIEL GLASSES, S.L (en adelante el RESPONSABLE) que puede incluir las siguientes operaciones:
Tramitar solicitudes y consultas planteadas al responsable
Informar sobre actividades y eventos organizados por el responsable Informar sobre productos o servicios ofrecidos por el responsable Interactuar a través de los perfiles oficiales
Cuando el RESPONSABLE recopile y trate datos personales a través de sus redes sociales, las PERSONAS USUARIAS serán informadas sobre la finalidad de la recopilación de datos, así como sobre sus derechos en relación a sus datos personales. Los datos personales se utilizarán únicamente para los fines indicados y se mantendrán de manera segura.
Base Jurídica del Tratamiento:el consentimiento explícito otorgado por la PERSONA USUARIA para el tratamiento de sus datos personales para uno o varios fines específicos (artículo 6.1.a GDPR).
Por otro lado, la PERSONA USUARIA puede acceder en todo momento a las políticas de privacidad de la propia red social, así como configurar su perfil para garantizar su privacidad.
¿Durante cuánto tiempo guardaremos sus datos personales?
Criterios de conservación de los datos:se conservarán mientras la PERSONA USUARIA no revoque el consentimiento prestado tal y como se indica en esta política de privacidad.
¿A quién facilitamos sus datos personales?
Comunicación de los datos: la información facilitada por la PERSONA USUARIA a través de las redes sociales del RESPONSABLE, incluidos sus datos personales, puede ser publicada, siempre en función de los servicios que la PERSONA USUARIA utilice, por lo que podrá quedar a disposición pública de otros terceros usuarios de las redes sociales. Desde el perfil de cada red social, la PERSONA USUARIA puede configurar qué información quiere hacer pública en cada caso, ver los permisos que se han concedido, eliminarlos o desactivarlos, como cualquier aplicación de un tercero que ya no se desea utilizar.
No obstante, no está prevista ninguna comunicación de datos personales a terceros fuera de la red social salvo, si fuese imprescindible para el desarrollo y ejecución de las finalidades del tratamiento, a nuestros proveedores de servicios relacionados con comunicaciones, con los cuales el RESPONSABLE tiene suscritos los contratos de confidencialidad y de encargado de tratamiento exigidos por la normativa vigente de privacidad.
¿Cuáles son sus derechos?
Derechos que asisten a la PERSONA USUARIA: solo podrán satisfacerse en relación a aquella información que se encuentre bajo el control del RESPONSABLE.
Derecho a retirar el consentimiento en cualquier momento.
Derecho de acceso, rectificación, portabilidad y supresión de sus datos, y de limitación u oposición a su tratamiento.
Derecho a presentar una reclamación ante la autoridad de control (www.aepd.es) si considera que el tratamiento no se ajusta a la normativa vigente.

2. UTILIZACIÓN DEL PERFIL
El RESPONSABLE realizará las siguientes actuaciones:
Acceso a la información pública del perfil.
Publicación en el perfil de la PERSONA USUARIA de toda aquella información ya publicada en la red social del RESPONSABLE.
Enviar mensajes personales e individuales a través de los canales de la red social.
Actualizaciones del estado de la página que se publicarán en el perfil de la PERSONA USUARIA.
La PERSONA USUARIA siempre puede controlar sus conexiones, eliminar los contenidos que dejen de interesarle y restringir con quién comparte sus conexiones; para ello deberá acceder a su configuración donde encontrará diferentes posibilidades de configuración en relación al grado de privacidad del perfil de usuario en la red social.
3. PUBLICACIONES
El objeto de las redes sociales, es dar visibilidad y difusión a las actividades que desarrolla el RESPONSABLE. Estas herramientas almacenan datos personales en los servidores de los servicios respectivos y se rigen por su propia política de privacidad.
La PERSONA USUARIA, una vez sea seguidora o se haya unido a la red social del RESPONSABLE, podrá publicar en la misma, comentarios, enlaces, imágenes, fotografías o cualquier otro tipo de contenido multimedia soportado por la misma. La PERSONA USUARIA en todos los casos, debe ser la titular del contenido publicado, gozar de los derechos de autor y de propiedad intelectual o contar con el consentimiento de los terceros afectados.
Se prohíbe expresamente cualquier publicación en la red social, ya sean textos, gráficos, fotografías, vídeos, etc. que atenten o sean susceptibles de atentar contra la moral, la ética, el buen gusto o el decoro, y/o que infrinjan, violen o quebranten los derechos de propiedad intelectual o industrial, el derecho a la imagen o la Ley. No se tolerarán comentarios o contenido ofensivo, difamatorio, ilegal o inapropiado en los perfiles de la empresa. La Empresa se reserva el derecho de eliminar dichos comentarios o contenido y bloquear a los usuarios responsables.
En estos casos, el RESPONSABLE se reserva el derecho a retirar de inmediato el contenido, sin comunicación previa, pudiendo solicitar el bloqueo permanente de la PERSONA USUARIA.
El RESPONSABLE no se hará responsable de los contenidos que libremente ha publicado la PERSONA USUARIA.
La PERSONA USUARIA debe tener presente que sus publicaciones serán conocidas por otros usuarios, por lo que él mismo es el principal responsable de su privacidad.
Las imágenes que puedan publicarse en la red social no serán almacenadas en ningún fichero por parte del RESPONSABLE, pero sí que permanecerán en la red social.
4. DATOS DE MENORES DE EDAD O PERSONAS CON CAPACIDADES ESPECIALES
Se recomienda la revisión y la lectura de las condiciones de uso y política de privacidad de cada red social en el momento de registro, teniendo en cuenta los diferentes requisitos de edad para la realización del mismo.
Asimismo, el RESPONSABLE quedará expresamente exonerado de cualquier responsabilidad que pudiera derivarse del uso de las redes sociales por parte de menores o personas con capacidades especiales y cuyo acceso debería realizarse bajo la supervisión y control de sus representantes legales.
El RESPONSABLE se reserva el derecho de modificar esta política en cualquier momento. Los cambios serán comunicados a través de nuestros perfiles de redes sociales y/o nuestro sitio web.
